You are required to have an EIN if you either have employees or have created another legal entity such as a corporation, LLC or partnership. If you are a sole proprietor with no employees you are not required to get an EIN. However if you don’t get an EIN you will have to use your SSN as your Tax ID for business purposes. That’s not a good idea these days, so getting an EIN is always a good idea.
